Terms & Conditions

These Terms & Conditions (T&C) govern the use of the mobile hot tub rental service operated under the EXI Moments / GurulóDézsa brand. By booking online and signing the rental contract, the Renter accepts these T&C.
1. Service provider

2. Service description
Activity
Rental of a modern mobile hot tub (fiberglass insert, wood-fired heater) with delivery within the Provider's service area — primarily Miercurea Ciuc, Odorheiu Secuiesc, Gheorgheni and Sovata. Available to private individuals and legal entities.
Optional accessories
Optional accessories (e.g. parasol, bathrobe) may be requested at booking or handover. Their list and prices are confirmed by the Provider with the booking.
3. Contract formation
Booking process
- The Renter submits the online booking form.
- The Provider confirms the booking by e-mail (moment of confirmation = booking guaranteed).
- On delivery day, the parties electronically sign the rental contract, which incorporates these T&C.
Electronic signature
The contract is concluded with a simple electronic signature under Romanian Law 455/2001, together with IP address, timestamp and device data. It has evidentiary value for rental contracts under the Romanian Civil Code.
4. Prices and payment
Rental fee
Current packages and rates are shown on the website's Pricing section. Peak-season periods may carry a multiplier, indicated on the site and in the booking confirmation.
Delivery fee
Delivery is free up to 20 km. Above 20 km: 1 litre of diesel per 10 km, at the daily market rate. The final amount is stated in the booking confirmation.
Payment methods
Rent is due when the service is provided — before delivery or during on-site setup, as agreed by the parties. Accepted methods:
- Cash on handover.
- Bank transfer to the account provided by the Provider at confirmation.
Online card payment is not currently available. The Provider does not require an advance, unless the parties agree otherwise in writing.
Security deposit
The Provider does not currently collect a deposit. In case of a damage claim, the value schedule in Section VII of the contract applies (trailer, hot tub, heater, accessories, itemised values). If a deposit is reintroduced in the future, it will be stated in the booking confirmation and this section will be updated.
5. Delivery and return
Delivery requirements
The Provider delivers and sets up the item at the address indicated by the Renter, provided the location meets: stable, level ground; nearby water supply; adequate ventilation for stove smoke and heat; road access. The Provider makes the final call on site suitability at handover.
Return
On the date set in the contract, the Renter shall have the item ready for pickup: hot tub drained, heater cooled and cleaned, ash removed. The Provider then collects the item.
6. Exclusion of the right of withdrawal
Romanian OUG 34/2014 art. 16(l)
The service constitutes provision of leisure services related to a specific period under Art. 16(l) of Romanian Emergency Ordinance 34/2014, and the 14-day right of withdrawal does not apply. The Renter acknowledges this exclusion via a dedicated checkbox during booking. In case of cancellation the policy in Section 7 applies.
7. Booking fee and cancellation policy
Booking fee
Once the Provider has received and reviewed the booking request, a booking fee of 100 lei is payable by bank transfer to the account provided by the Provider in order to confirm the reservation.
- The booking fee counts toward the total rental price.
- If the Renter cancels the booking at least 14 days before the start date, the Provider refunds the booking fee in full.
- If the Renter cancels less than 14 days before the start date, the booking fee is non-refundable — as compensation for the reserved capacity that can no longer be resold.
Rental cancellation policy
The rental fee (i.e. the total price less any booking fee already paid) is calculated according to the time of cancellation, as follows:
- 7+ days in advance — free cancellation; the rental fee is not charged (the booking fee is handled per the rule above).
- 3-7 days in advance — the Provider may retain 50% of the rental fee as compensation for reserved capacity.
- Less than 3 days — the Renter bears 100% of the rental fee.
In force majeure situations (natural disaster, official restriction, severe illness with medical certificate), the parties may agree on a full refund.
8. Provider guarantees to the Renter
Booking guarantee
By confirming the booking, the Provider commits to making the service available during the reserved period.
Service warranty
The delivered item is clean and sanitized, works properly (heater operational, tub watertight), and is safe. If a defect prevents normal use at handover, the below applies.
Handover defect remedies
- The Renter may refuse acceptance without payment; OR
- The Provider supplies a replacement within 24 hours or grants a proportional discount;
- If remediation fails, the Renter may terminate the contract and receive a full refund within 5 working days.
Provider cancellation (force majeure etc.)
If the Provider cannot deliver, they shall notify the Renter immediately, at least 24 hours before the scheduled service; offer a replacement date or item; and if the Renter declines the replacement, refund all paid amounts within 5 working days. The Provider's liability is limited to the amount paid by the Renter; the Provider is not liable for indirect or consequential damages (such as event cancellation costs).
Support during the rental period
The Provider is available by phone and e-mail throughout the rental, with a response within 4 hours during business hours for breakdowns.
9. Renter obligations and liability
Use for intended purpose
The Renter uses the item with the diligence of a prudent owner, following the manual. Normal wear from correct use does not give rise to Renter liability.
Damages
In case of misuse, willful misconduct or gross negligence, the Renter bears the actual repair / replacement cost (Art. 1357 Romanian Civil Code) per the value schedule in Section VII of the contract. In case of disagreement, an independent expert's opinion prevails.
Prohibited uses
- Unsupervised use by minors under 18.
- Use under the influence of alcohol or drugs.
- Subletting the item.
- Moving the item without the Provider's prior written consent.
10. Complaints
Primary channel
The Renter may submit complaints to the Provider's e-mail (ervinxizolda@gmail.com). Reply within 15 days.
Consumer protection authority
Consumers may contact the Romanian National Authority for Consumer Protection (ANPC): anpc.ro.
EU online dispute resolution
For disputes arising from online purchases, the EU ODR platform is available: ec.europa.eu/consumers/odr.
11. Governing law, language, jurisdiction
Governing law
This contract is governed by Romanian law. The T&C and contract may be drafted in multiple languages; in case of discrepancy, the Romanian version prevails.
Jurisdiction
The parties settle disputes by negotiation. Failing amicable settlement, jurisdiction belongs to the court of the Renter's domicile (Art. 113(1) point 8 of the Romanian Civil Procedure Code).
12. Amendments
T&C updates
The Provider reserves the right to update the T&C. The version in force at the time of booking applies to that relationship. The current version is always available on this page.
